Two sisters charged with assaulting two others following a Kamloops bar fight may have acted together as a forceful team, or maybe they did not, a judge said Friday.
Provincial court judge Stephen Harrison said he can’t be sure there is enough evidence to prove beyond a reasonable doubt that Enfya and Ursula Zielke attacked two other people following the altercation in the bar more than a year ago.
Witnesses who testified at the women’s trial said the two attacked two other people outside the bar and carved a large ‘Z’ in one of the victim’s cars.
Judge Harrison said if he’d heard only from the Crown’s witnesses, he would have convicted but Ursula Zielke also testified, and her story creates enough reasonable doubt about what happened that it’s impossible to be legally certain.
Harrison said Ursula told the court she came to her sister’s aid after Enfya was attacked outside the bar.
The judge said he suspects the victims’ version of events might be closer to the truth, but suspicions are not enough.
Harrison acquitted both women of the charges.
Meanwhile, obstruction of justice charges, sworn by the Crown in the middle of the trial, remain outstanding. The Crown alleges Ursula Zielke intimidated one of the victims, whom she met outside of court one day.
The three-day trial was held last week.
